Terms and conditions
Version 7 · as of 16 Oct 2026
This is a translation for convenience; the German version is authoritative.
§ 1 Scope and provider
These terms apply to all contracts for the purchase of digital 3D printing files (STL, 3MF, ZIP) through the online shop "Layerfuchs" between Birthelmer Digital, owner Sebastian Birthelmer, Lichtenfelser Straße 39a, 96103 Hallstadt, Germany ("we") and the customer ("you").
Deviating terms of the customer do not apply unless we expressly agree to them.
§ 2 Subject matter
Only digital content is sold. No physical products are sold or shipped. You receive a simple, not transferable right to use the files. The scope results from the license terms (one license including the right to sell printed pieces). The license terms form part of the contract.
§ 3 Conclusion of contract
- The presentation of products in the shop is not a legally binding offer but an invitation to order.
- You add products to the cart, enter your details at checkout and can review and correct them at any time before submitting. By clicking "Place order and pay" you submit a binding offer to purchase.
- The contract is concluded once payment has been completed successfully and we make the files available for download. You will then receive an order confirmation by email.
- The contract languages are German and English.
- We store the contract text (order data and the legal texts valid at the time of the order). You can view your order in your customer account or via "Access order"; you receive the invoice by email.
§ 4 Prices and payment
- All prices are final prices in euros. They include statutory VAT where applicable. There are no shipping costs.
- Payment is processed by the payment service provider Stripe using the payment methods offered at checkout (e.g. credit/debit card, Apple Pay, Google Pay). The purchase price is due immediately upon ordering.
§ 5 Provision and download
- After successful payment the files are available for download immediately. You can download purchased products and bundles permanently, for as long as this shop is operated, and as often as you like.
- If a purchased product is updated, you receive the new version free of charge and can also download it permanently.
- Free products (freebies) require a customer account with a verified email address. They can be downloaded as often and for as long as you like.
- To download you need internet access and a current browser; to use the files you need software that can process the respective file formats (STL, 3MF) and a suitable 3D printer. Notes on print settings can be found in the respective product description.
§ 6 Right of withdrawal
Consumers have a statutory right of withdrawal. Details are set out in the withdrawal policy. For digital content, the right of withdrawal expires under the conditions stated there once the download starts.
§ 7 Usage rights and violations
- The files are protected by copyright. The digital files may never be sold, shared, uploaded or passed on, neither unmodified nor modified.
- In the event of a material breach of the license terms we may block the download rights. Further statutory claims remain unaffected.
- If an order is refunded, the usage rights and download rights for the refunded items end.
§ 8 Rights in case of defects
The statutory rights regarding defects in digital products apply (Sections 327 et seq. of the German Civil Code). The print result also depends on the printer, material and settings, which are beyond our control.
§ 9 Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
- In the event of a slightly negligent breach of a material contractual obligation (an obligation whose fulfilment makes the performance of the contract possible in the first place and on whose observance you may regularly rely), liability is limited to the foreseeable damage typical for this type of contract.
- Otherwise, liability for slight negligence is excluded.
§ 10 Final provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory protective provisions of the country in which you have your habitual residence remain unaffected.
- If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered location.
- We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
- Should any provision of these terms be invalid, the remainder of the contract remains valid.
